2. Acceptance of These Terms
These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “user”, or “client”) and Firecone (“we”, “us”, “our”).

4. Accounts & Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
You must notify us immediately at [email protected] if you suspect unauthorized access. Firecone is not liable for losses resulting from unauthorized access unless caused by our gross negligence.
5. Payments, Wallet & Billing
5.1 Wallet System
Firecone may offer a prepaid wallet or balance system.
- Funds must be deposited before services can be activated
- Wallet deposits are non-refundable once credited
- Services are not automatically renewed unless explicitly stated
5.2 Non-Payment & Suspension
If your wallet balance becomes insufficient or payment fails:
- Services may be suspended immediately or after a short grace period
- Firecone is not responsible for interruption caused by non-payment
- Data associated with suspended services may be permanently deleted after 14 days of suspension
6. Refunds & EU Consumer Rights
Due to the nature of digital services:
- Wallet deposits are non-refundable
- Refunds for unused services may be granted solely at Firecone’s discretion
EU Right of Withdrawal
If you are an EU consumer, you expressly agree that:
- Service provisioning begins immediately after purchase
- By requesting immediate service delivery, you waive your 14-day right of withdrawal once provisioning has begun, in accordance with EU consumer protection law
7. Acceptable Use
You may not use the Services for unlawful, harmful, or abusive activities, including but not limited to:
- Violating applicable laws or regulations
- Hosting or distributing malware or malicious code
- Infringing intellectual property rights
- Sending spam or unsolicited communications
- Attempting to disrupt, overload, or compromise systems or networks
- Impersonating individuals or entities
Firecone may suspend or terminate Services for violations of this section.
8. Server Access & Maintenance
Firecone may access customer services or servers when reasonably necessary to:
- Perform maintenance or upgrades
- Resolve technical issues
- Ensure system security and stability
We will make reasonable efforts to minimize disruption.
9. Intellectual Property
You retain ownership of content you upload or store on the Services.
Firecone does not claim ownership over user content but may process it as necessary to provide the Services.

10. Privacy & Data Protection

For hosting services:
- You act as the Data Controller for any personal data you upload or process
- Firecone acts as the Data Processor
A Data Processing Agreement (DPA) is available upon request and is incorporated into these Terms.
11. Third-Party Services
The Services may integrate or link to third-party tools or services.
Firecone is not responsible for third-party content, policies, availability, or practices. Your use of third-party services is subject to their respective terms.
12. Termination
Firecone may suspend or terminate your account or Services immediately if:
- These Terms are violated
- The Services are misused
- Required by law or security concerns
Upon termination:
- Access to Services and data may be permanently lost
- Firecone is not obligated to retain data
- Personal data will be handled in accordance with our Privacy Policy and legal obligations
13. Disclaimer of Warranties
The Services are provided “as is” and “as available”.
To the maximum extent permitted by law, Firecone disclaims all warranties, express or implied, including fitness for a particular purpose, availability, and uninterrupted operation.
14. Limitation of Liability
To the maximum extent permitted by law, Firecone shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Unauthorized access or third-party actions
Firecone’s total liability shall not exceed the amount paid by you for the affected Service during the previous billing period.

Abusive disputes or chargebacks may result in suspension or termination of Services.
19. Miscellaneous
- These Terms constitute the entire agreement between you and Firecone
- Failure to enforce any provision is not a waiver
- If any provision is unenforceable, the remainder remains valid
- Firecone is not liable for events beyond reasonable control (force majeure)
